Oversight Committee (TROC) that two programmed projects’ funding be reprogrammed to three different projects under the Draft Scope Change Policy approved by TROC. TROC approved one project to be reprogrammed and denied two other projects on a tied motion and a failed motion. The City of Gary is appealing this vote to the Technical Planning Committee.

      Minutes


      Call to Order - Chairman Geof Benson called the meeting to order at 9:00 a.m. with the Pledge of Allegiance. The meeting was streamed live.


      Executive Board members present included Geof Benson, Diane Noll, Karen Freeman-Wilson, George Topoll, Anthony Copeland, Justin Kiel, Ed Soliday, Tom McDermott, Jim Ton, Mark Krentz and Greg Stinson.


      Commissioners present included Jeannette Bapst, Kevin Breitzke, Robert Carnahan, Christine Cid, Bill Emerson, Jr., Jane Jordan, Tom Schmitt, Dave Shafer and Mary Tanis.

      Public Comment – Jim Nowacki, Gary resident, commented on the US Highway 12-20 and State Route 53 projects.


      Minutes – On a motion by Jim Ton and a second by George Topoll, the minutes of the April 19, 2018 Executive Board meeting were approved as presented.


      Report of the Executive Director – Ty Warner introduced NIRPC’s newest staff members. The Marquette Greenway will connect Chicago, Illinois to New Buffalo, Michigan and an application for the BUILD grant will be submitted. A CBS video on the Marquette Greenway, interviewing Mitch Barloga, was shown. The State of Michigan raised $500,000 for the project. The Greenways+Blueways 2020 Plan was made available to Commissioners today and it is also on the website. The National Association of Regional Councils presented NIRPC with an award for the Greenways+Blueways 2020 Plan at its conference, where Geof Benson was officially named President of NARC


      Report of the Chair – Geof Benson also commented on the June NARC conference and also recognized Justin Kiel serving on the NARC Board. Geof Benson and Ty Warner joined a group arranged by the Mid- Ohio Regional Plan Commission to visit Hyperloop One’s testing grounds in the Mojave Desert. A brief video on Hyperloop was shown. The Chicago-Columbus-Pittsburgh corridor was selected by Hyperloop One as one of ten for further feasibility study in a global competition. The next NARC Board meeting will be held in Cleveland in October and the 2019 conference will be held in Omaha, NE.


      Finance & Personnel Committee – George Topoll said the committee met this morning to review the financial status, reconciliation of expenses, and approve the claims register. Daria Sztaba explained three amendments recommended by the Finance & Personnel Committee needing action for environmental programs, utilities and Communication budget. On a motion by George Topoll and a second by Karen Freeman-Wilson the Executive Board approved the budget amendments.


      Lisa Todd explained two procurement recommendations for two replacement vehicles for LaPorte TransPorte in the amount of $240,000 and a tree purchase for $87,500. On a motion by George Topoll and a second by Jim Ton the Executive Board approved the budget amendments.

      Environmental Management Policy Committee – Bill Emerson, Jr. said the committee met in June hearing presentations on the Deep River Dam public comments and a summary of the Marquette Action Plan. Storms caused a lot of damage to the Kankakee River and there is concern at the local and federal level. Illinois is on board as well. EMPC will meet on September 6. Kevin Breitzke added that there is optimism for positive results for the Kankakee River damage.


      Technical Planning Committee – Kevin Breitzke reported that the Technical Planning Committee met in May and July, hearing reports on the 2050 Plan development. The first round of public comments effected recommended vision statements and critical paths. The TPC offered a preliminary endorsement of these statements and paths.


      Charles Bradsky summarized the 30-day public comment period on amendments 13 and 14 to the FY 2018- 2021 Transportation Improvement Program. He overviewed Resolution 18-10, amendment 13 for four local projects. On a motion by Greg Stinson and a second by Jim Ton, the Executive Board approved amendment 13. Charles Bradsky overviewed Resolution 18-11, amendment 14 for four INDOT projects. On a motion by Jim Ton and a second George Topoll, the Executive Board approved amendment 14.


      James Winters explained that no comments were received during the 7-day public comment report on Amendment #15 to the FY 2018-2021 Transportation Improvement Program. The amendment is for GPTC projects funded under 5339 for bus and bus facility capital projects. These projects were in the previous TIP and needed to be added to the FY 2018-2021 TIP. On a motion by Jim Ton and a second by Greg Stinson, the Commission voted to adopt Resolution 18-12, Amendment #15 to the FY 2018-2021 Transportation Improvement Program. The next meeting of the Technical Planning Committee is scheduled for August 14, 2018 at 9 a.m. at NIRPC.


      Indiana Department of Transportation – Matt Deitchley reported on the Community Crossings program, Trax, and said that I-65 work is on time and scheduled for completion in the fall. Ed Soliday commented that while the Community Crossings funding is closing for this year, the program will continue. Rick Powers said Lyndsay Quist was promoted and will join the Central Office of INDOT.


      Certification Review – Susan Weber reported that NIRPC received several commendations for the Travel Demand forecasting, the updated functional classification system, the bike and ped plan. She noted her excitement for the BUILD grant application which identifies regional and interstate cooperation in a project. The corrective action was for public involvement and engagement and making it more meaningful. NIRPC was certified to continue to receive federal funding. Ty Warner added that NIRPC has objected to the corrective action as unwarranted but has no issue with what the corrective action asks NIRPC to do.


      Announcements

      • Bob Carnahan said the Northwest Indiana Symphony will hold a free concert in Cedar Lake Saturday at 7:30 either outdoors or at Hanover High School.

      • Dave Shafer thanked INDOT and Rep. Soliday on behalf of the Town of Munster for their help with the railroad for getting the grade separation at Calumet and 45th Avenue. He also thanked the Lake County Surveyor for his involvement with the Lake County Drainage Board for the Hart Ditch becoming a regulated ditch.

      • Mary Tanis said the Legislative Committee will meet in September, date to be announced. The Communitrees grant projects are due August 1.

      • Ty Warner re-emphasized that the TPC endorsed preliminary endorsement of the 2050 Plan matrix found on the last page of the packet and asked the Commission to be familiar with these vision and focus statements, as they will form the basis of the 2050 Plan development. Kevin Breitzke added that the plan will come before the commission for adoption next year, but comments are welcomed at any time.

      • Geof Benson said NIRPC may be consolidating meetings in order to make better use of time and create a better flow.

      • Susan Weber directed attention to the formation of an Outreach Committee in the NIRPC committee structure and Warner indicated this would be discussed further in the meeting with FHWA and FTA.


      Adjournment – Hearing no other business, on a motion by George Topoll and a second by Diane Noll, Geof Benson adjourned the meeting at 10:00 a.m.

Approval of Minutes

The minutes of the June 21, 2018 meeting were approved as presented on motion by Christine Cid and second by Jim Ton.


Review of Financial Status – June 2018

  1. Daria Sztaba presented the June bank reconciliations for the NIRPC general fund account, the LaPorte County Revolving Loan fund (RLF) and the Sequestered Revolving Loan Fund. A check for

    $1,200 was deposited in error to the general account fund instead of the RLF account. The cash receipt was deposited correctly on the general ledger. The adjustment was made to the RLF account.

  2. Daria Sztaba presented the Budget to Actual Expenditures Report for January through June 2018. Salaries, fringe benefits, maintenance, contractual and capital outlays categories are all currently under budget. Four amendments were proposed to transfer funds for the occupancy and departmental categories due to them being over budget. Total expenditures of the NIRPC general fund are at $228,820 for the year, which is 56% under budget.


Approval of Claims Register – June 2018

Daria Sztaba presented the June 2018 claims register. January subrecipient reimbursements were made for January thru March. A budget amendment is proposed to move funds from the contractual category to the communications category for the payment made to Miller Beach Arts & Creative District for the CMAQ grant sponsorship of the Take Bike the Streets program. On motion by Christine Cid and second by Dave Shafer, the Committee approved the claims register.


Budget Amendments

  1. Amendment 1 proposed transferring $55,000 from the environmental contracts line item to the environmental program line item for the bicycle safety program. On motion by Jim Ton and second by Diane Noll, the Committee approved Amendment 1 for recommendation to the NIRPC Executive Board.

  2. Amendment 2 proposed transferring $1,600 from copier leasing/maintenance and $1,400 from telephone service/maintenance line items for a total of $3,000 into the utilities line item due to the increased rate being 7% instead of the projected rate of 3%. On motion by Dave Shafer and second by Karen Freeman-Wilson, the committee approved Amendment 2 for recommendation to the NIRPC Executive Board.

  3. Amendment 3 proposed transferring $10,000 from the salaries category to the commission/executive director line item to pay for bike safety promotion costs. The promotional items were budgeted for the CMAQ program for FY19 and the funds have not yet been approved for spending. On motion by Dave Shafer and second by Karen Freeman-Wilson, the committee approved Amendment 3 for recommendation to the NIRPC Executive Board.

  4. Amendment 4 proposed a $6,500 transfer within categories to compensate for cost increases correlated to wages. A total of $6,500 would be transferred from health insurance with $2,500 to workers compensation, $3,000 to life & disability insurance and $1,000 to unemployment compensation. On motion by Christine Cid and second by Diane Noll, the Committee approved Amendment 4.


    Procurement Recommendations – Procurement #18-05.02

    Lisa Todd reported procurement 18-05.02 is for the purchase of trees native to the Northwest Indiana Lake Michigan Watershed area to mitigate the canopy loss from the emerald ash borer. The trees will be purchased with a U.S. Forest Service grant, with expenditures not to exceed $87,500 in federal funds.

    The Communitree program will distribute the trees to the local communities who apply. On motion by Jim Ton and second by Karen Freeman-Wilson, the Committee approved the procurement for recommendation to the Executive Board.


    Internal Control Procedures

    Daria Sztaba presented the revised Internal Control Overview Documenting Segregation of Duties. Revisions requested at the prior Finance & Personnel Committee meeting held June 21st addressed in the updated document included sections for checks and funds handling and the Family Express credit card. Daria Sztaba confirmed only fuel and car washes may be purchased with the Family Express credit card. A brief discussion was held regarding the recording of the NIRPC van mileage when fuel purchases are made. Daria indicated mileage would be recorded on the NIRPC form. On motion by Christine Cid and second by Dave Shafer, the Committee approved the revised internal control procedures.


    IDECL Incorporated Addendum to the Agreement

    Kathy Luther presented the Committee with an addendum to the agreement between the Northwestern Indiana Regional Planning Commission (NIRPC) and the Indiana Dunes Environmental Learning Center (IDELC) for propane fuel purchase reimbursements through the CMAQ program. There is a surplus of funds remaining on the two TIP items for $40,000 each. The surplus of funds will also be used to purchase fuel for the new vehicle being purchased by the IDELC. On motion by Dave Shafer and second by Jim Ton, the Committee approved the extension of the project through June 30, 2020.

        RESOLUTION 18-13


        A RESOLUTION OF THE NORTHWESTERN INDIANA REGIONAL PLANNING COMMISSION AMENDING THE

        FY 2018-2021 TRANSPORTATION IMPROVEMENT PROGRAM FOR LAKE, PORTER, AND LAPORTE COUNTIES, INDIANA

        AMENDMENT NO. 16

        August 16, 2018


        WHEREAS, Northwest Indiana’s citizens require a safe, efficient, effective, resource- conserving regional transportation system that maintains and enhances regional mobility and contributes to improving the quality of life in Northwest Indiana; and


        WHEREAS, the Northwestern Indiana Regional Planning Commission, hereafter referred to as “the Commission”, being designated the Metropolitan Planning Organization (MPO) for the Lake, Porter and LaPorte County area, has established a regional, comprehensive, cooperative, and continuing (3-C) transportation planning process to develop the unified planning work program, a transportation plan, and a transportation improvement program to facilitate federal funding for communities, counties, and transit operators, and to provide technical assistance and expertise to regional transportation interests; and


        WHEREAS, the Commission performs the above activities to satisfy requirements of the Fixing America's Surface Transportation (FAST) Act of 2015 (PL 114-94), applicable portions of all prior federal transportation program authorizing legislation, as well as other federal, state, and local laws mandating or authorizing transportation planning activities; and


        WHEREAS, the FY 2018-2021 Transportation Improvement Program is a product of a multi-modal, 3-C transportation planning process, compatible with regional goals and objectives and socio-economic and demographic factors used to form the 2040 Comprehensive Regional Plan (CRP), as amended; and


        WHEREAS, the FY 2018-2021 Transportation Improvement Program is an implementation of the 2040 Comprehensive Regional Plan (CRP), as amended; is fiscally constrained, and is consistent with the State Implementation Plan for Air Quality; and

        WHEREAS, the FY 2018-2021 Transportation Improvement Program is developed by the Commission in coordination and cooperation with local elected and appointed highway and transit officials, special interest and service organizations, including users of public transit, the Indiana Department of Transportation, the Indiana Department of Environmental Management, the U.S. Federal Highway Administration, the U.S. Federal Transit Administration, and the U. S. Environmental Protection Agency; and


        WHEREAS, the changes to the FY 2018-2021 Transportation Improvement Program brought about by this amendment were reviewed by the Air Quality Conformity Task Force’s Interagency Consultation Group (ICG); and


        WHEREAS, the changes to the FY 2018-2021 Transportation Improvement Program brought about by this amendment were subjected to public comment in the manner prescribed by the 2014 Public Participation Plan with no comments received; and


        WHEREAS, the Technical Policy Committee (TPC) has recommended that the Northwestern Indiana Regional Planning Commission make these changes to the FY 2018-2021 Transportation Improvement Program.


        NOW, THEREFORE, BE IT RESOLVED that the Northwestern Indiana Regional Planning Commission hereby amends the FY 2018-2021 Transportation Improvement Program by adding the new projects and making other changes as shown on the attachment to this resolution.


        Duly adopted by the Northwestern Indiana Regional Planning Commission this sixteenth day of August, 2018.

        Members of Northwestern Indiana Regional Planning Commission:‌


        Last November (2017) the Transportation Resources Oversight Committee for Lake & Porter Counties accepted a policy that would allow sponsoring communities to bring forward to TROC a proposal to change the scope of any given project, essentially the ability to create a new project if there was no way to construct the original project. As mentioned, that policy had passed the Lake & Porter TROC. LaPorte TROC denied the policy, so the policy is still in DRAFT status. That policy is attached.

        Last month on July 31, a TROC ad-hoc meeting was held and the City of Gary presented three proposals to exercise this policy. The city had distributed to all committee members, prior to the meeting, a handout of the presentation with all of the pertinent information. This handout is also attached. The three proposals were presented separately for a vote. One proposal passed, one proposal did not, and one proposal was given a “No Decision”. The city’s proposals and their outcome are attached.

        Pursuant to the draft policy is an option to appeal TROC decisions. The City of Gary has stated that they wish to appeal to the TPC, and if needed, the full commission for a ruling. The three items mentioned above contain the information needed for a decision to be made if needed.

        DRAFT Project & Scope Change Policies

        November 2017


        Draft policy about new projects substituting for existing TIP projects:

        New projects proposed to be substituted for those that exist in the TIP must receive approval from TROC. Those projects that are considered must adhere to the following prerequisites:

        • Non-exempt projects only.

        • The TIP project must have been awarded at least five (5) years prior to the TROC meeting date of new project request, with no funds obligated for any phase.

        • New project must remain in the same LPA jurisdictional boundary of TIP project.

        • Scope of new project shall be in the same category of TIP project. An example would be a road project substituting for another road project, and not a transit or trail project.

        • Proposed federal share of new project must not exceed 110% of TIP project's federal award.

        • New project must not exceed programmed fiscal year construction date of TIP project.

        • Project sponsor must include a comparative scoring between the old and new projects under the most recent scoring criteria for that category.

        • If the TIP project was from specific funding source with different eligibility criteria (CMAQ, TAP, HSIP), then the new project might have to go back through FHWA & FTA eligibility.


          If a new project meets these prerequisites, but is still denied by TROC, a project sponsor would be able to appeal this decision to the TPC.


          Draft policy for project scope changes:


          All TIP-programmed project scope changes must be submitted in writing to NIRPC staff for review. Based on staff review, if scope change is determined to be major, it will be forwarded for TROC review. TROC will determine if the proposed scope change is significant enough to remand to topical committees based on project type. Topical committees will review the following project types:9

          • Environmental Management Policy Committee: Environmentally-based projects - water quality, air emissions, remediation

          • Ped, Pedal & Paddle: Non-motorized projects - trails, sidewalks, bike lanes, road diets

          • Land Use Committee: Centers for Livable Community (CLC) projects, projects that affect adjacent land uses, corridor planning, Transportation Orientated Development (TOD), or any other land-use plans

          • Rail Vision/Freight: Freight-based projects, either rail, highway or port related

          • Transit Operators Roundtable: Transit projects, operations & maintenance

          • Surface Transportation Committee: All highway-based projects - resurfacing/rehabilitation, bridges, signals, intersections/roundabouts, ITS


    Topical committees will review remanded projects, and submit to TROC a recommendation. TROC will decide on scope change proposal based on topical committee

    review, and internal discussion. If a scope change is denied by TROC, a project sponsor would be able to appeal this decision to the TPC.


    If project scope change is determined by TROC to be minor, it will approve the request and forward a letter to INDOT LaPorte office. No further action will be needed.

    City of Gary

    Proposed Scope Changes


    Proposed Change 1

    The City of Gary proposes shifting funding from the 15th Avenue & Martin Luther King Blvd Intersection Improvement project (DES#0710064) to the Airport Road Phase II Improvement project (DES#1600418). The $1,396,000 in reallocated funding (which includes the local match) would go toward improved lighting, signage, and landscaping across 2.8 miles of Airport Road, from Cline Avenue to Clark Road, and would leverage the $9 million in road reconstruction work that is underway on the corridor. This project will improve the primary gateway to the Gary Chicago International Airport, and strengthen it as an important economic asset for Gary and Northwest Indiana. This shift aligns the City’s infrastructure improvement dollars with a project in a key economic development area, where existing Tax Increment Financing from the City’s Lakefront TIF District can provide a viable source of local funding to match the project’s federal grant dollars.

    PASSED; VOTE: 5 FOR – 3 AGAINST


    Proposed Change 2

    The City of Gary proposes shifting the scope of the Ridge Road Reconstruction project (DES#1172078) to the 15th Avenue Gateway project. The $3,000,000 in reallocated funding would go toward the repaving and reconstruction of 15th Avenue, Michigan Street, and Texas Street, between Interstate 65 and Martin Luther King Boulevard. This project will improve the primary gateway between the Interstate 65 and the new HMD Trucking Headquarters, planned to open in Gary in 2021. This shift aligns the City’s infrastructure improvement dollars with a project in a key economic development area, where existing Tax Increment Financing from the City’s Midwest Center TIF District can provide a viable source of local funding to match the project’s federal grant dollars.

    NO DECISION; VOTE: 4 FOR – 4 AGAINST – 1 ABSTENSION


    Proposed Change 3

    The City of Gary proposes shifting the remaining funding from the Ridge Road Reconstruction project (DES#1172078) to the East Lakefront Complete Streets project (via a new designation number). The anticipated $2,600,000 in reallocated funding would match $6.1 million in pledged state and local funding, and go toward adding bike lanes, and improving sidewalks, landscaping, lighting, and signage on Lake Street and US 12 & 20. This project will advance transit-oriented development and economic development around the Miller South Shore commuter station and improve access to the Indiana Dunes National Lakeshore. This shift aligns the City’s infrastructure improvement dollars with a project in a key economic development area, where existing Tax Increment Financing from the City’s East Lakefront TIF District, and other sources, can provide a viable source of local funding to match the project’s federal grant dollars.
